MANILA (1st UPDATE) - The Bureau of Internal Revenue (BIR) filed tax evasion charges with the Department of Justice (DOJ) against Philippine Basketball Association (PBA) players Jimmy Alapag and Jared Dillinger of the Talk ‘N Text Tropang Texters.
Alapag was assessed a total tax liability of P17.86 million for taxable years 2007 to 2010 and between 2007 to 2012 for value-added tax returns (VAT).
The BIR said that Alapag earned some P32.28 million as a cager.
Dillinger, meantime, allegedly did not file his income tax returns from 2008 to 2011, failed to file his VAT returns from 2009 to 2012 and also did not file his percentage tax return for 2008.
Dillinger was assessed a total tax liability amounting to P13.37 million. His supposed income as a cager amounted to P22.19 million, according to the bureau.
In a statement, Alapag and Dilinger said they were suprised by the filing of tax complaints since the deadline for them to submit documents has not yet lapsed.
"On 22 Feb 2013, Messrs. Jimmy Alapag and Jared Dillinger received an Audit Notice from the Bureau of Internal Revenue (BIR). While in the process of compiling the documents requested by the BIR, Jimmy & Jared received on 13th March 2013, a second Notice. This second Notice, dated 11th March 2013, requested for the reproduction of a number of documents, the deadline of submission which was set on 18th March 2013," the players said.
However, they said they would get legal advice and cooperate with authorities.
"Jimmy & Jared were therefore extremely surprised with the press statements earliertoday announcing the complaints being filed against them. Jimmy & Jared will cooperate with the tax authorities while they seek legal advice to protect their rights."
Complaint vs. non-accredited tax practitioner
Meanwhile, the BIR also filed a case against a Malolos City-based bookkeeper, Annalyn D. Forbes for "unlawful pursuit of business and making it appear that she filed the tax returns of her clients."
The BIR sent separate letters/notices to several of Forbes' clients, who, in turn, submitted "fake" photocopies of tax returns and bank receipts as proof of payment.
These clients executed affidavits to reveal Forbes' alleged modus operandi and requested that she be investigated.
BIR Deputy Commissioner Estela Sales said their investigation showed that Forbes did not pay the required Annual Registration Fee of P500 annually for 2008, 2009, and 2010 for her accounting and bookkeeping services. The probe also revealed that she is not an accredited tax practitioner for said years, Sales added.
The cases against Alapag, Dillinger and Forbes are the 154th to 157th filed by the BIR under its Run After Tax Evaders (RATE) program under the Aquino administration. -- with a report from Coco Alcuaz, ABS-CBN News Channel

Kris Aquino files protection order vs ex-hubby James Yap

Accusing her former husband James Yap of overstepping his boundaries and of attempting to seduce her while visiting her home, and of inflicting psychological harm on their son James, or “Bimby,” actress and TV host Kris Aquino has filed a temporary protection order (TPO) from a Makati City court.
The TPO will be good for 30 days from its issuance, although after a hearing, the petition also asks that the protection order be made permanent.
“Protection orders” are a provision of the law against violence against women and their children to protect victims of domestic violence from further harassment or harm by their spouses or partners.
In the petition, Kris asked the court to order Yap to stay away from her, her 5-year-old son Bimby and any household member, keep a distance of at least 100 meters, and to stay away from her residence, school, place of employment or any place frequented by her and her son.
As detailed in the petition, during a visit to Kris’ condominium unit last December to pick up his son as part of his twice-weekly visitations with Bimby, Yap entered his former wife’s bedroom and made “overt sexual advances,” which Kris vigorously resisted, provoking Yap to “utter mean and malicious statements” in the face of rejection.
The petition cited that James acted “as if he was still entitled to his matrimonial rights,” even if they are no longer married, forcing himself on her in full view of their son.
Horrified by the scene, which was followed by a heated argument, Bimby told his father to leave the room and to “stop hurting” his mom, the petition added.
The petition also mentioned that Bimby had even positioned himself between his parents, and begged his mother to “tell him to go away.” Since then, the petition said, the 5-year old has exhibited signs of being highly upset and agitated whenever he is in his father’s company or when he hears his voice on the phone.
“The physical, sexual, emotional, psychological and moral harm and injury foisted (on that day) was occasioned by the unfettered access of respondent Yap on the household and persons of the petitioners,” the petition noted.
Kris and James’ marriage was finally deemed annulled last year, with a settlement of several properties and a “hefty sum” going to Yap. The petition also states that despite the grant of twice-weekly visitation rights to the professional basketball player, Yap showed hardly any interest in seeing Bimby, getting together with the boy for a maximum of 10 times in a year.
