    Right of first refusal is used in NBA free agency. i believe in PBA, the famous incident is the Patrimonio tender offer of Millions offered by Pepsi(?) which is big at the time, but matched by Purefoods. also Tanduay offer to Ildefonso of 160M(?) from SMB haha. then nothing of the sort occurred again.

    we really don't know what's written in PBA Uniform Player Contract (UPC). PBA said they own player rights unless they release it. some posters already mentioned that this is unconstitutional. i hope Kiefer challenges this (settlement or legal battle). this is a stretch but this may determine if Kiefer plays for Gilas. same with Thirdy and GDL bros. i'm thinking PBA board will dissuade SBP to enlist their services.

      Here are the relevant provisions to this issue, just in case:

      Sec. 3, par. 1, Art. XIII of the Constitution states that "The State shall afford full protection to labor, local and overseas, organized and unorganized, and promote full employment and equality of employment opportunities for all."

      Sec. 18, Art. II provides that "The State affirms labor as a primary social economic force. It shall protect the rights of workers and promote their welfare." Unfortunately, this is not a self-executing provision, meaning, Congress has to pass a law to enforce this policy. However, I think the Labor Code's declaration of policy is enough.

      Art. 12 (b) and (c) of the Labor Code states that it is the policy of the State to protect every citizen desiring to work locally or overseas by securing for him the best possible terms and conditions of employment and to facilitate a free choice of available employment by persons seeking work in conformity with the national interest.

              Reading posts on social media specially by those PBA apologists makes my head hurt. I remember people are calling this gilas as ateneo team, like hello? Bakit di nyo sabihan yung PBA at SMC teams nyo na ipahiram sa national team ung fav players nyo. The fact we have to beg for PBA to lend players to play sa national team is so mind boggling to me. Tapos sasabihin na PBA malaking naitutulong nila, they're like credit grabber more than anything.

                Its either these people are the typical ignorant, irrational, low I. Q. types belonging to the class C, D & E mentality or just blinded by their biases. Either way, they don't deserve our attention.

                And this isn't descrimination. There are valid reasons why rational & heady people want to be around with & interact with fellow smart & logical people.

                    • Bayaan ninyo na pba. It is a marketing organization, and not a nationalist institution.

                      The better option was always to have a separate pinoy fiba pro league. It can have two seasons: a regular one, and an invitational tournament.

                      In the invitational contest, cooperating pro 16-man teams from china, korea, iran and japan can be automatically seeded in best-of-five quarterfinals against top 4 pinoy teams. Then they go best of five until the finals.

                      Maganda din 4 asian teams in one year, 2asian-2african teams the following year, 2asian-2latin american groups the year after that, etc.

                      This win-win arrangement will strengthen all nt players in the participating foreign and pinoy teams.

                          We have multiple leagues that can be candidates, specifically the NBL, VisMin Cup, MPBL. Do we get the FIBA pro league from them, or do we form a new one?

                          And secondly, FIBA will have to accredit this league as the official league in the Philippines.

                              Alex the Great rightly said, fortune favors the bold. If no league wants to show up the pba by creating better, more internationally competitive flavored, or more exciting games, none may deserve fan and commercial interest. If they want to be smalltimers, then smalltimers they can only be.

                              You think that say an ilocos norte team will have less fans than ginebra against say a sokor top team? Or, would a manila team, funded by many manila firms, spend less on a prestigious match against a top chinese team?

                              Besides, if the interested league wants to play by fiba rules, then it gets the fiba approval, and not the pba.

                              That league will have the glory of selecting players for national teams.
