  • Yup salary cap won't work in the pba. Teams can say players a salary is 200k, but not included in his package are his game bonuses, championship bonuses, housing, car etc. The rich trams will just focus on that, so if I'm a free agent and an independent team offers me 150k with basic perks and not a good chance to win, while smb/ TNT offers me 80k, but with extreme perks, I'd go with the latter 10/10.

                The closest I can think of is unfair labor practice (ULP for short).

                Here are the following instances of ULP by employers under the Labor Code:

                (a) To interfere with, restrain or coerce employees in the exercise of their right to self-organization;
                (b) To require as a condition of employment that a person or an employee shall not join a labor organization or shall withdraw from one to which he belongs;
                (c) To contract out services or functions being performed by union members when such will interfere with, restrain or coerce employees in the exercise of their right to self-organization;
                (d) To initiate, dominate, assist or otherwise interfere with the formation or administration of any labor organization, including the giving of financial or other support to it or its organizers or supporters;
                (e) To discriminate in regard to wages, hours of work and other terms and conditions of employment in order to encourage or discourage membership in any labor organization;
                (f) To dismiss, discharge or otherwise prejudice or discriminate against an employee for having given or being about to give testimony under this Code;
                (g) To violate the duty to bargain collectively as prescribed by this Code;
                (h) to pay negotiation or attorney's fees to the union or its officers or agents as part of the settlement of any issue in collective bargaining or any other dispute; or
                (i) To violate a collective bargaining agreement.

                The most on point is probably violation of a CBA. However, do the PBA players even have a CBA?

                • So SMC also supports banning BRP? That's a bad move. The guy just wants to play for Ginebra. Why not suspend him just like Calvin and then offer him a path for reinstatement.

                    We dont know.

                    Maybe Smc have some hidden bad blood with Rayray too.

                    But the bottomline is ALL PBA BOARDS/GOVERNORS IN EACH PBA TEAM Have a Gentleman's ageement to ban Rayray.

                    Lets be honest, Rayray did some mistakes too. But I don't think it deserves a ban.

                      • Parks thought SMC will grab him. because of his unprofessional treatment to his team. i don’t think SMC will like it. if he just talked to his bosses if he wants to out, ask them politely. if i were TNT Thompson, Tolentino and 2 future 1st rd pick. Deal!!hahahaha.

                            PBA legend Ramon Fernandez said in 2017 that he believes it's about time current PBA stars band together and revive the long-dormant players' union, especially in the wake of the controversy over players' contract disputes.

                            The four-time PBA MVP spearheaded the creation of a players' union back in the eighties, which they envisioned would look after the welfare of both active and retired players, especially in disputes with mother ballclubs.

                            The PBA players' association, however, has long been inactive, unlike in the NBA where the union has vast clout and influence when it comes to issues surrounding the players, from contract issues to suspensions.

                              Ginebra will never trade Scottie. He's a fan fave, one of the most popular in the team. Considering the next draft is as deep as this year's draft, I think Arvin + Chan + Salado + 2 future 1st round picks (expect 10th pick to 12th pick) is more reasonable. Although even with those players, I'd say a trade like that is still lopsided, considering Rayray is a great player.

                                Usually, players na nag-iinarte just want to play for a team of their choice. Remember the case of Japeth. Arte din dati until mapunta sya sa Ginebra, nawala attitude nya. Greg Slaughter nagrebelde bec ayaw nya matrade, he likes to stay sa team of his choice. Unfortunately for him, naisahan sya ni Longhair. And here comes Rayray. Same reasons for pag-aattitude.
