Won't disagree with your preferences. But I would disagree with the reasoning.
Not because a player was "robbed" of the MVP title should give him an automatic slot at the Top 40. Of course, the criteria of insertion in the list if one becomes MVP is the argument here, but it doesn't mean a robbed one equates to a slot.
Otherwise, here's a list of players who should be in the Top 40 because of this reason:
1. Yoyoy Villamin - "robbed" in 1987
2. Nelson Asaytono - "robbed" in 1992
3. Marlou Aquino - "robbed" in 1997
4. Bong Hawkins - "robbed" in 1996
5. Davon Harp - "robbed" in 2002
6. Danny Seigle - "robbed" in 1999, 2000 and 2001
7. Kerby Raymundo - "robbed" in 2006
8. Jayson Castro - "robbed" in 2013
Please observed that amongst those you mentioned, the Dynamite was "robbed" 3 times unlike the other players who were "robbed" only once. Based on this, you can see how consistent of a good player he is. He was also named finals MVP for a couple of times thats why i think he deserves to be one of the top 40. The younger generations would surely be part of the top 50, surely james, pingris and maybe even Jason wouldnt mind if they will be named in the next batch. But JJ and Kerby? I know they too are deserving the spot but compared to DS, Nelson, Olsen and even Jun, in my opinion these betters are more deserving.
its fun watching the two empires stockpile on talent. they're doing it by getting established stars. the independent teams like alaska and ROS do it the old fashioned way, by developing young talent. all these are good for us fans. we get to watch high quality basketball between super talented teams.

No disagreement. I actually have DS in my list that also includes Abe King, Arnie Tuadles, Nelson Asaytono and either Jeff Cariaso or Olsen Racela. I just disagreed with the rationale that players who have been "robbed" of MVP titles should have been included. It shouldn't work that way.
Lingganay was dropped to the unrestricted list for alleged game fixing. When KIA learned that NLEX was interested in him, he was immediately moved to the restricted list so NLEX had to do a trade to get him.
What's the use of the unrestricted list then, when you can so easily put him back to the restricted slot? I know there are limited restricted slots but still..

it just probably meant nobody picked him up from the unrestricted list so kia was able to get him again.
